METALMORFIK TERMS AND CONDITIONS
PAYMENT TERMS Product costs and shipping and handling costs are billed prior to shipment. After placing your order, we will E-MAIL you a copy of the invoice. Methods of payment will be included with the invoice. On orders less than $3,500.00, full payment is required at the time of the order unless prior arrangements have been made. Orders more than $3,500.00 may be prepaid or half the total may be prepaid with the remainder to be paid C.O.D. However, please be aware that the freight fines levy an additional collection fee on all C.O.D. shipments equal to approximately 3-4% of the total price with a minimum $35 charge. You also need to know that there is no freight discount on minimum shipments if the shipment is not direct and if the shipment is C.O.D. Any balance due on orders not prepaid in full will be collected at the time of delivery. Shipping charges are also to be paid upon delivery unless billed to a major credit card or prepaid to METALMORFIK. For prepaid shipping charges, a $32 service fee is added. The C.O.D. balance must be paid with a certified check. Late payment will void any discounts and /or allowances. Purchaser will pay a late fee of 2% per month as well as all collection costs. A returned check fee of $50.00 will be charged for each occurrence. A $60.00 charge will be made for each invoice after the original invoice. Any legal disputes will be resolved according Michigan law and venue shall be in Oakland County Michigan. Federal issues will be resolved in Michigan or closest jurisdiction to Michigan. CANCELLATIONS AND RETURNS Cancellations will not be accepted without a charge on orders that we are in the process of filling. On stock products there is a 25% restocking fee, and all returns must be approved by METALMORFIK. You will be responsible for all freight charges incurred. Custom orders cannot be returned. Fill out the Return Request Form on our website for return authorization. No returns after 30 days from original invoice. DAMAGE In the unlikely event damage occurs, please read and understand the following information. METALMORFIK is not responsible for loss or damage in transit. Any damage claims must be filed against the carrier. Therefore, it is extremely important to inspect the shipping crate/box for any visible damage before unpacking the merchandise, i.e. scuffs, dents, tears or creases. If a crate/box appears to be damaged, open it and took for damage. Often the crate/box will be damaged but not the contents. If the contents are damaged, refuse delivery and have the freight line return it. Refuse any shipment by writing on the bill of lading, " Damaged Goods in Shipment-Return to Sender" and sign the bill. METALMORFIK will then file a claim against the carrier and place a reorder. You do have the right to open it to inspect contents (ICC Regulation 120). If the crate/box appears to be in good condition, begin unpacking the contents. If there is no damage and the order is complete, sign the bill of lading. If goods are damaged, do not finish unpacking until the carrier has completed inspection and noted damage or missing items on the delivery ticket. Please do not dispose of any damaged units or packing materials. The carrier will inform you of procedures to follow when completing the damage claim. You must note damaged or missing items on the ticket yourself. Again, do not sign the bill until you are certain that all merchandise is in good condition or that the damaged crates have been noted. It is much more difficult to collect for concealed damage after the order has been accepted. Once you sign the bill of lading with no damage noted, you have accepted the merchandise as is and METALMORFIK cannot file a claim against the carrier. All damage claims must be filed within 48 hours of receiving shipment. SHIPPING UPS If your shipment is being delivered, the driver will bring the merchandise inside. Simply sign for delivery and if there is any damage contact UPS for instructions. COPYRIGHT NOTICE Unless otherwise stated in writing, purchaser agrees that he/she will not make any copies or reproductions of any kind of METALMORFIK products, literature, drawings or mockups. Product purchases are for individual use or resale. Violation of these terms is a copyright infringement. All legal recourse will be taken to remedy such actions. PATINA SAMPLES Unless otherwise stated in writing, sample patinas are in an approximate range. The surface treatments are done by hand so exact matches are not possible. This is the quality that makes Metalmorfik products unique and desirable. WARRANTY We offer a limited warranty that will replace repair or refund purchase price at our discretion any product proven to be defective for a period of five years from purchase. The maximum liability is the purchase price of the product.
